Even if you disagree with the first couple paragraphs (Bob, Chuck, KH), keep reading. Theres a lot more going on in the middle and end than just military practical theory.

He has a good point toward the back third of his essay that is really the key to the whole thing: We at home cannot judge the actions of a soldier because of the fact that we're not there, and war is hell. The soldier who got indicted for shooting a civilian should not have been tried for anything. He was in a war, and things happen in war that we may not like to hear about, but that's the endorsement you give when your elected government sends the troops overseas into a war zone.
I don't disagree with the first few paragraphs. All I have ever complained about with respect to this issue is that they are held without trial for an indefinite amount of time.
My solution is not to release them, as Otter knows from our discussions. Rather, it is to have an elected (or appointed by a non-governmental agency) official who is given the clearance to make a determination as to their guilt and determine appropriate circumstances for their continued incarceration or release.
I say this only because of my concern for basic human rights - not because I believe they are mistreated or abused (Hell, where are the liberals with respect to the embarassing violence in our civilian prisons?) Again, all I want is some non-governmental oversight committee or official (with clearance) who can make a determination and represent the individual detainees. Otherwise, I have no disagreements with Bill Whittle, who has long been an excellent and compelling writer of social and political commentary.
