Just because you have the right of way does not mean that I'm necessarily going to be able to come to a stop from 35mph in a three-foot span.

And remember, having the right of way is no consolation if you end up as roadkill...
It pretty much doesn't matter if someone is in the crosswalk or not. If I'm on the road, everyone is in danger. Sidewalks are actually more of a target.
